The morning of June 2, 2010 started out like most other busy days on the farm of Vernon & Erma Hershberger and their family of eight boys and one girl, ranging in age from 18 down to 2 years. Shortly before 10:00 a.m., Vernon went to pick up some equipment from a neighboring farm. Immediately after he left, Cathleen Anderson, Regulatory Specialist from the Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) along with Sauk County Health Department Sanitarians, Nick Oasen and Mitch Lohr, arrived and entered the farm store building, paying no heed to “Private Property” signs posted on the building. Erma immediately called Vernon on his cell phone; and she asked the officials to wait for him outside the building, which they did, stepping out into the parking lot.

Vernon refused consent even after they threatened to get a warrant, explaining to the officials that they had no jurisdiction to inspect his farm because he had not applied for a license and he was not selling to the public but merely distributing products to members of his private buying club.

Upon arriving at the scene, Vernon was asked by Anderson for his consent to let them do an inspection of his private facility. Vernon refused consent even after they threatened to get a warrant, explaining to the officials that they had no jurisdiction to inspect his farm because he had not applied for a license and he was not selling to the public but merely distributing products to members of his private buying club.

Last week, the feds sent the Environmental Protection Agency out to harass the sovereign state of Texas. Texas needs to reclaim the spirit of Davy Crockett, when he famously proclaimed “you may all go to hell, and I will go to Texas”; and send the federal agency packing. Here’s why and how.

EPA’s Goal is Centralization of Power
By sending the EPA to Texas, the federal government’s goal is not environmental improvements. The goal is centralization of power. The tactic is to use the unelected bureaucrats of the EPA to increase Texas dependence on the federal government through arbitrary and economically crippling regulation.

Refinery permits are just tools that the EPA intends to use to control the Texas oil and gas industry. EPA control can force Texas into dependence in at least two ways. First, though excessive regulation of a major industry, economic growth will be stifled. This will create more state dependence on federal funds. Second, unnecessary EPA regulations will cost Texans jobs. This is will create individual dependence on welfare programs and since these programs include state-mandated funding, Texas will be hit with additional liabilities.

The Texas Land Office and Texas Water Commission successfully used ‘oil eating’ microbes to clean up large oil spills in just weeks. Red tape always gets in the way. If the federal government would get out of the way, and stop playing god, creativity and answers would be released at the local and state levels.

I second the motion to get this to Governor Jindal of LA, The states of Florida, Miss, TX, Glen Beck, Governor Huckabee, Sara Palin, Tea Party People, OAK, We the People and anyone else who will listen. Anyone know HOW to contact them? We must do an end run around the government, it seems, initiated by “We the People.”

Gulf Oil Spill-Gutsy Solution Restores Environment in Just Six Weeks

President Obama will be handed the power to shut down the Internet for at least four months without Congressional oversight if the Senate votes for the infamous Internet ‘kill switch’ bill, which was approved by a key Senate committee yesterday and now moves to the floor.

The Protecting Cyberspace as a National Asset Act, which is being pushed hard by Senator Joe Lieberman, would hand absolute power to the federal government to close down networks, and block incoming Internet traffic from certain countries under a declared national emergency.

Despite the Center for Democracy and Technology and 23 other privacy and technology organizations sending letters to Lieberman and other backers of the bill expressing concerns that the legislation could be used to stifle free speech, the Senate Homeland Security and Governmental Affairs Committee passed in the bill in advance of a vote on the Senate floor.

In response to widespread criticism of the bill, language was added that would force the government to seek congressional approval to extend emergency measures beyond 120 days. Still, this would hand Obama the authority to shut down the Internet on a whim without Congressional oversight or approval for a period of no less than four months.

The Senators pushing the bill rejected the claim that the bill was a ‘kill switch’ for the Internet, not by denying that Obama would be given the authority to shut down the Internet as part of this legislation, but by arguing that he already had the power to do so.

I invite you to read for yourself his misnamed “National Security Strategy” – misnamed because it is actually a blueprint for running the whole world like he’s been running the United States since January 2009.

Obama is hardly the first president to plead for America to join a New World Order. It started with the first George Bush and has continued unabated through three more administrations. But Obama’s so-called “National Security Strategy” has little to do with securing the U.S. from threats and much more to do with turning over the U.S. to the illegitimate authority of global organizations.

It starts early in the table of contents: “Promoting a Just and Sustainable International Order.”

Woodrow Wilson tried with the League of Nations. Franklin D. Roosevelt tried with the United Nations. I guess we’re going to keep trying this path until we get it right.

I looked at him in uniform so young, so tall, so proud, with hair cut square and eyes alert he’d stand out in any crowd.

I thought how many men like him had fallen through the years. How many died on foreign soil how many mothers’ tears?

How many pilots’ planes shot down? How many died at sea. How many foxholes were soldiers’ graves? No, freedom isn’t free.

I heard the sound of Taps one night, when everything was still. I listened to the bugler play and felt a sudden chill.

A New Orleans federal judge lifted the six-month moratorium on deepwater drilling imposed by President Barack Obama following the largest oil spill in U.S. history. Shares of drilling services companies jumped on the news.

Obama temporarily halted all drilling in waters deeper than 500 feet on May 27 to give a presidential commission time to study improvements in the safety of offshore operations. More than a dozen Louisiana offshore service and supply companies sued U.S. regulators to lift the ban.

U.S. District Judge Martin Feldman today granted a preliminary injunction, halting the moratorium. Government lawyers told Feldman that ban was based on findings in a U.S. report following the sinking of the Deepwater Horizon rig off the Louisiana coast in April.

Comments on Article 3, Section 8, paragraph 3 of the U.S. Constitution

“The Congress shall have the power…..to regulate Commerce with foreign nations, and among the several states, and with the Indian Tribes.”

This phrase in the Constitution was and is being used to justify any and all types of Federal regulation of most all industries, including the health care, education, and the food industries. I have personally heard from a conservative Texas Republican Congressman that even the October 3, 2008, $700 Billion bailout was constitutional, using the infamous “interstate commerce” clause to justify his position. When the predominance of human action can be reduced to “commerce,” there is nothing that escapes the grasp of the Federal government. Yes, where there is commerce, there is money, and where there is money there are taxes….and lobbies, and political gifts. Is it any wonder that this is such popular interpretation of both Republicans and Democrats?

Moreover, the broadness of this interpretation nullifies any force and meaning of the 10th Amendment. If the extent of legal regulation is broadened to extend to all forms of commerce, what is left for the people and the States, traffic laws, and murder?
